01. Purpose, Acceptance & Scope

Please read these Terms of Service ("Terms") carefully. By accessing or browsing the Harkle website (https://harkle.in), requesting web development services, or interacting with our automated WhatsApp pipelines—including CHOLA DESK—you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our website or interact with our WhatsApp messaging services.

02. Scope of Services & CHOLA DESK Platform

Harkle Digital Studio provides bespoke web application engineering, automation software, and digital consulting services.

As part of our automation offerings, Harkle operates the software infrastructure and WhatsApp Cloud API pipelines for CHOLA DESK. CHOLA DESK is a specialized operations platform developed for Chola Air Travels (Pattukkottai, Tamil Nadu) that enables operators to compose, calculate, format, and dispatch real-time commercial flight quotations, itinerary schedules, and PDF quotation documents to passengers via WhatsApp.

03. Nature of Flight Quotations & Booking Disclaimer

• No Guaranteed Ticket Reservation: A quotation does not constitute a confirmed airline ticket, an issued Passenger Name Record (PNR), or a guaranteed seat reservation until the customer explicitly confirms the booking, submits necessary travel documentation, and completes payment.
• Airline Fare & Schedule Volatility: Commercial airline fares, fuel surcharges, government taxes, baggage allowances, and seat availability fluctuate in real time according to operating airline revenue management systems. Harkle and Chola Air Travels cannot hold airline fares or seat inventory without formal ticket issuance.
• Validity Cutoff: Quotations may include an indicated validity window. Once this validity period expires, fares and availability are subject to re-calculation based on live carrier pricing.

04. Acceptable Use & User Responsibilities

When using our website or communicating through our WhatsApp channels, you agree to:

• Provide accurate, genuine, and truthful contact details, passenger names, and travel requirements.
• Use the services strictly for lawful, personal travel inquiries or legitimate commercial requests.
• Refrain from sending abusive, threatening, obscene, discriminatory, or harassing messages to desk staff or automated lines.
• Refrain from transmitting unsolicited marketing, spam, broadcast spam, or automated bot floods to our WhatsApp numbers.
• Refrain from attempting to reverse engineer, decompile, scrape, probe, or breach any API, server, or webhook endpoint (/api/whatsapp/webhook).

Violation of any acceptable use policy will result in immediate termination of communication and potential blacklisting of the offending telephone number or IP address.

05. WhatsApp Communication & Third-Party Limitations

Communications through WhatsApp are subject to technical and operational dependencies outside our direct control:

• Delivery Dependency: Message transmission depends upon third-party telecommunications networks, mobile carriers, internet service providers, and the Meta WhatsApp Business Platform.
• No Guarantee of Instantaneous Delivery: While the majority of WhatsApp messages deliver within seconds, Harkle cannot guarantee 100% uninterrupted delivery, error-free transmission, or instantaneous receipt. Message delays may occur due to device power states, network congestion, SIM connectivity, or Meta infrastructure maintenance.
• Carrier Charges: Standard mobile carrier data rates and cellular messaging fees may apply when you receive messages or download quotation PDF documents via WhatsApp.
• Opt-Out: You may stop receiving WhatsApp communications from CHOLA DESK at any time by replying with STOP or by sending a deletion request as described in our Data Deletion Instructions.

06. Third-Party Infrastructure & External Services

Our website and automation platform integrate with and rely upon several third-party service providers:

• Meta Platforms, Inc. — WhatsApp Cloud API messaging and webhook services.
• Supabase, Inc. — Cloud PostgreSQL database hosting and storage.
• Cloudflare, Inc. — Edge CDN, DNS routing, and serverless compute infrastructure.
• Airlines & Global Distribution Systems (GDS) — Airline flight schedules, fares, and ticket issuance.

We are not responsible or liable for any service interruptions, outages, policy modifications, or failures caused by these independent third-party platforms.

07. Intellectual Property Rights

All content, layout designs, branding, logos, graphics, code, and software workflows published on https://harkle.in are the intellectual property of Harkle Digital Studio and Hari, protected under applicable copyright and intellectual property laws.

"Chola Air Travels" and related travel trade logos are property of Chola Air Travels. "WhatsApp" and the WhatsApp logo are registered trademarks of Meta Platforms, Inc. All other carrier names and trademarks referenced belong to their respective corporate owners.

08. Disclaimer of Warranties & Limitation of Liability

To the maximum extent permitted by applicable law, Harkle Digital Studio, its founder (Hari), operators, and affiliates shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages.
• Loss of profits, revenue, travel opportunities, or business interruption.
• Airline flight cancellations, rescheduling, delays, missed connections, or denied boarding imposed by operating carriers or airport immigration authorities.
• Delays, transmission errors, or failures resulting from telecommunications carriers or Meta WhatsApp infrastructure.

09. Governing Law & Jurisdiction

These Terms of Service and any dispute, controversy, or claim arising out of or related to your use of Harkle services shall be governed by, and construed in accordance with, the laws of the Republic of India.

Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts situated in Tamil Nadu, India.

10. Modifications to These Terms

We reserve the right to revise or update these Terms of Service at any time at our sole discretion. Any changes will be posted directly to this page with an updated "Last Updated" date. Your continued access to the website or use of our WhatsApp quotation services following the posting of revised Terms constitutes your acceptance of the changes.
